Clarksville Wrongful Death Lawyers
Tennessee handles wrongful death differently from most states, and the differences matter: there is one claim rather than a claim for each family member, the law sets an order of who may bring it, and the money that comes out of it does not pass through the estate. Understanding that early prevents a great deal of pain later.
In Tennessee, the claim belongs to the person who died
Most states treat wrongful death as a new claim created for the surviving family. Tennessee does not. Tennessee’s wrongful death statute is a survival statute: the claim the deceased person would have had, had they lived, does not die with them. It passes forward and is brought on their behalf.
That one structural point drives nearly everything else about these cases:
- There is a single claim, not several. Family members do not each file their own case. One action is brought for the benefit of the statutory beneficiaries.
- Loss of companionship is inside the claim, not alongside it. A surviving spouse’s and children’s loss of consortium is part of the pecuniary value of the deceased person’s life, rather than a separate cause of action.
- The proceeds pass outside the estate. Wrongful death proceeds go to the statutory beneficiaries directly and are generally beyond the reach of the deceased person’s creditors. For a family facing medical bills and collection letters, that is a significant protection and one most people do not know they have.
Who has the right to file
Tennessee law establishes an order of priority, and it is not always the order families expect. The surviving spouse has the first right to bring the action. If there is no surviving spouse, the right passes to the children, and from there down the statutory line.
The provision that causes the most conflict is this one: a spouse who was separated from the deceased person at the time of death generally still outranks the children. A marriage that had effectively ended, but was never legally dissolved, can leave a separated spouse controlling the case over adult children who were close to their parent. Tennessee courts have addressed misconduct and abandonment in this context, and the outcome depends heavily on the particular facts.
If your family is in that situation, raise it in the first conversation rather than the fifth. Who controls the claim, and how proceeds are allocated among beneficiaries, are questions that are far easier to handle at the beginning than after a settlement is on the table.
What can be recovered
Losses to the family
The pecuniary value of the deceased person’s life: lost earnings and earning capacity over a working lifetime, the value of the services and guidance they provided, and the loss of love, society, and companionship suffered by the spouse and children.
Losses to the person who died
Medical expenses from the final injury or illness, funeral and burial costs, and the physical and mental suffering the person experienced between the injury and death. Where death was not instantaneous, that element can be substantial.
Tennessee’s cap on noneconomic damages, $750,000, rising to $1 million in catastrophic cases, applies to wrongful death claims. Economic losses are not capped.
The deadline is short, and how it is measured is fact-specific
Tennessee’s one-year limitation period under T.C.A. § 28-3-104(a)(1) applies to wrongful death actions. One year is a genuinely short window for a family that is also arranging a funeral, sorting out an estate, and in many cases waiting on a medical examiner or a criminal investigation.
Exactly when that year begins to run, and how it is affected where the beneficiaries are minor children, has been litigated in Tennessee and depends on the circumstances of the case. Do not rely on anything you read, here or elsewhere, to calculate your own deadline. If someone in your family died because of someone else’s conduct, get the date checked by a lawyer now, even if you are not ready to decide whether to pursue a claim.

Questions families ask
There is a criminal case against the person responsible. Should we wait for it?
No. The criminal case and the civil claim are separate proceedings with different purposes, different standards of proof, and different timelines. A criminal prosecution can take years, and waiting for it can run your one-year civil deadline out. The two can proceed in parallel, and a conviction can help the civil case.
Do we have to open a probate estate?
Not necessarily for the wrongful death claim itself, because the proceeds pass to the statutory beneficiaries rather than through the estate. There may be other reasons to open an estate, and in some circumstances a personal representative brings the action. We can tell you which applies in your situation.
Our family does not agree about this. What happens?
It is more common than you would think, and it is manageable. The statute sets who has the right to bring the action, and courts can resolve disputes over allocation of proceeds among beneficiaries. The worst version of this is the one nobody addresses until settlement.
The insurance company offered a settlement already. Is that a good sign?
It means they have assessed their exposure, usually before you have. Accepting closes the claim for everyone it covers, permanently. Have it reviewed.
What does it cost to talk to you?
Nothing, and there is no obligation. We handle wrongful death cases on a contingency fee, which means the fee comes from the recovery and there is no fee if there is no recovery.
